Zorbit’s Math Inc. (ZMA) is committed to protecting the privacy of our users.

ZMA collects information, which it uses in a number of different ways, in order to provide a personalized education experience.

ZMA collects information directly from students of School Users over the internet in the form of the data that is created when they use ZMA products and services. This data is used to measure a student’s performance and to adapt ZMA products and services to meet the student’s learning needs. The data is analyzed to provide teachers with ongoing progress reports. It is also used to improve ZMA’s products and services.

This Privacy Statement applies to personal information collected at zorbitsmath.com. There are two main classes of users of zorbitsmathadventure.com – School Users and Family Users. School Users access ZMA’s products and services by virtue of an agreement we have in place with the user’s employer, institution (educational or otherwise), or other organization (“Organization”). Family Users access Zorbit’s Math products and services by virtue of downloading apps from the Apple App Store or Google Play or by accessing zorbitsmathadventure.com.

If you are a School User, this statement does not affect the terms of any agreement between you and your Organization. You should read and understand the terms of any privacy statement or policies that you enter into with parties other than us, including your Organization, as those policies may also explain how your personal information is used by those parties.

Data collected from Family Users through the ZMA apps includes but may not be limited to when a student or child begins and ends a play session, the answers or solutions they provide or choose, how long it takes them to answer, and the choices they make when customizing characters. This information is used to personalize each child’s experience and provide information to parents regarding their children’s use. All such data is collected and stored locally on your personal device(s).

CONSENT TO ZORBIT’S MATH ADVENTURE (ZMA) PROCESSING INFORMATION ABOUT YOU

By providing us with any information or sharing information with others (including sensitive information), you are expressly and voluntarily accepting the terms and conditions of this Privacy Policy and any applicable user agreement (including an end user license agreement or service agreement) that allows us to process information about you.

COLLECTION OF PERSONAL INFORMATION

Personal information is information that can be used to personally identify you or is associated with any such information, such as your name, email address, mailing address, etc. This Privacy Policy does not apply to information we collect in the aggregate. We may aggregate student data with the data of other students who use ZMA products and services for marketing and other business-related purposes. Aggregate information will be anonymous and will not identify students or be combined with other information that would allow individual students to be identified.

We may collect personal information from School Users in the following ways:

Registration: In order to access some ZMA products and services, you will be asked to create an account. This will require you to provide us with information that may include your name and email address and other personally identifiable information.

Information You Choose to Provide: Certain ZMA products and services ask you to provide additional information about yourself or others. Providing additional information beyond what is required at registration is up to you, but providing additional information may enable you to derive more benefit from ZMA products and services.

Student Information You Provide: Once you have registered, you may then sign up your student(s) by providing each student’s first name. We may also require a process to verify your consent to the registration of your student and to the collection of your student’s Registration Information. When you and your student(s) use ZMA’s products and services, ZMA will automatically collect information about your patterns of usage, session data, and other information relating to usage, choices, and preferences, including that of your student(s).

Customer Service and Support: We may collect information about you if your Organization has contracted with us for end-user support and you use that support, or if you have been approved as a support contact under our agreement with your Organization, and you contact our support service. This information may include your name, email address, and other personally identifiable information.

Websites, eCommerce, and Other Marketing Initiatives: At zorbitsmathadventure.com we may ask you to provide information such as your email address, name, employer name, home or work address, or telephone number. We may also collect demographic information such as your postal or zip code, gender, age, preferences, interests, and favorites.

We may collect personal information from you such as your name, email address, telephone number, and Organization information when you sign up for webinars, product trials, newsletters, contests, or other marketing initiatives through zorbitsmathadventure.com.

When you set up an account to access the ZMA Teacher Dashboard, we collect information such as your name, email address, and Organization. You may also choose to add a photo and other personally identifiable information to your profile.

When you post information to the ZMA Teacher Forum, you share your profile information with other community members as well as any personally identifiable information you may choose to share within your questions, responses, and comments.

USER-GENERATED CONTENT

Within the ZMA Teacher Dashboard, there is a forum. When individuals post to the forum and share attachments through the forum, this is regarded as User Generated Content or UGC. UGC is defined as digitally produced content in a variety of file formats that has been created by teachers or others. Such content can be shared by users using a range of tools. Users may not share content that is copyright, or material for which permission has not been granted by the original owner. UGC shared on the ZMA Teacher Dashboard forum is done so on the understanding that the original owner grants other users the right to download, use, and adapt that material for their own teaching and learning needs.

COOKIES AND WEB BEACONS

ZMA uses cookies and web beacons to collect information about the pages you visit, the links you click, and other actions you take when you use the ZMA website and other ZMA products and services. Cookies and web beacons must be enabled for ZMA products and services to function properly.

INFORMATION COLLECTED BY YOUR ORGANIZATION

If you are a School User, your Organization may collect information of its own relating to your use of ZMA products and services. Such collection and use of information is governed by the privacy policies of your Organization and is beyond our control.

WHAT WE DO WITH YOUR INFORMATION

When you provide information, that information may reside on our systems, or on systems belonging to our service providers.

In addition to using your information to help us provide you with the products and services you have requested, we use your information to operate and improve those products and services. These uses include customer service, making products and services easier to use by eliminating the need to enter the same information repeatedly, performing research and analysis aimed at improving our products and services, and displaying content and promotions customized to your interests and preferences.

Some ZMA products and services incorporate features such as forums, messaging, and other ways to share. If you are a School User, permissions with respect to which features are enabled and who has access to those features are determined by your Organization.

Information collected through ZMA products and services may be stored by or processed by us or our service providers in the United States or Canada. The laws of the jurisdiction in which the information is stored and processed will apply to its storage and processing.

If you submit personal information through the ZMA website, it may be used to provide the products and services you requested and for related activities. Related information may include sharing your information with sales and / or marketing personnel who may contact you with further information that may be of interest to you.

  • Any sensitive online information is transmitted over secure channels.
  • All student data are stored in ways that are not publicly accessible.
  • Security audits are regularly performed to ensure data integrity.

When you receive newsletters or promotional emails from us, we may use web beacons, customized links, or similar technologies to determine whether or not the email has been opened and which links you have clicked. This allows us to provide you with more focused email communication and other information.

IF YOU ARE A SCHOOL USER

Information collected through the use of our support service is intended to help resolve issues as quickly as possible and to ensure you can be notified of our progress in resolving any issues you have reported.

Your Organization may use information collected through your use of ZMA products and services in a manner that is different than what is set out in this Privacy Policy. Any use of your information by your Organization is subject to the privacy policies of your organization and is beyond our control.

COMMUNICATIONS WE SEND

We may communicate with you through email or any other channel of communications that forms part of a ZMA product or service. We may send emails that inform you about features of ZMA products or services, and we may also send you service messages related to the function of ZMA products and services. We may send you promotional information from ourselves or on behalf of our partners.

If you sign up for webinars, MOOCs, product trials, pilot projects, contests, or other professional development, research, product development, or marketing initiatives through the ZMA website, employees of ZMA may contact you with information about ZMA products and services as well as promotions that may be of interest to you.

SHARING YOUR INFORMATION WITH THIRD PARTIES

It is possible that from time to time we may share your information with third parties who are not our partners or service providers. That would happen only in the following circumstances:

  1. We have your express consent through an opt-in option provided to you.
  2. We have a good faith belief that access, use, preservation, or disclosure of your personal information is reasonably necessary to
  • satisfy any applicable law, regulation, legal process, or enforceable governmental request;
  • enforce applicable terms and conditions of this Privacy Policy or any applicable agreement, including investigation of potential violations thereof;
  • detect, prevent, or otherwise address fraud, security, or technical issues;
  • protect against harm to the rights, property, or safety of us, our users, or the public as required or permitted by law.

Except for the sale of all or most of our assets, we will not sell, trade, or rent your personal information to third parties who are not our partners or service providers unless we have your express consent.

ZMA does not share information with any third parties that could be used to personally identify students. If a school requests that student data be sent to a third party, ZMA will send the data to the school and never directly to the third party.

INFORMATION YOU SHARE WITH OTHERS

ZMA’s products and services may allow you to share information with or send communications to other users or the general public. You (or if you are a School User, your Organization) may select the other users with whom you share or to whom you send this information. Once you share information with or send information to other users, however, those other users may share your information at their discretion.

YOUR OPTIONS FOR YOUR PERSONAL INFORMATION

Accessing and Correcting Your Personal Information

You can opt out of receiving promotional information from us by following the unsubscribe procedures indicated in the promotional information itself.

If you are a School User, retention of your personal information is governed by the privacy policies and is the responsibility of your Organization and may be subject to our archival policies.

Please be aware that as long as you have access to ZMA products and services, you cannot opt out of receiving service messages from us. If we send communications to you via the carrier service with which you have a mobile communications subscription or otherwise have access, you are responsible for paying any service fees associated with your receipt of messages on your mobile device, including text messaging charges.

Information Security

ZMA takes appropriate security measures to protect against unauthorized access to or unauthorized alteration, disclosure, or destruction of data. These include internal reviews of our data collection, storage, and processing practices and security measures, including appropriate encryption and physical security measures to guard against unauthorized access to the system where we store personal data.

We restrict access to personal information to ZMA employees, contractors, and agents who need to know that information in order to process it on our behalf. These individuals are bound by confidentiality obligations and may be subject to discipline, including termination, as well as civil action and criminal prosecution, if they fail to meet these obligations.

No data transmissions over the internet can be guaranteed to be 100 percent secure. Thus while ZMA does have security precautions in place to protect against the loss, misuse, or alteration of information under our control, we do not guarantee that we will eliminate all risk of misuse of your personal information that we receive or store on our or our service providers’ systems.

You are responsible for keeping any passwords confidential to prevent unauthorized access to and use of any ZMA products or services to which you have access.

If you are a School User, your Organization is responsible for ensuring the system is configured to properly restrict access to information in accordance with its privacy statement or policy, and that anyone with access to that information is covered by its privacy statement or policy.

 

Protection of Children’s Personal Information

If you are a School User, your Organization may collect information on its own through the use of ZMA products and services. Collection of information in this way is governed by the privacy policies of your Organization and is beyond our control.

Other than collecting the first name of students with the explicit consent of their teachers, we do not knowingly collect any personal information from students through ZMA products or services.

 

European Union Data Protection

To the extent that ZMA stores data in the United States, we and our service suppliers and partners comply with the U.S.-EU Safe Haven Framework as set in force by the U.S. Department of Commerce regarding the collection, use, and retention of personal information from EU member countries.

If you reside in the EU, upon registration for any ZMA product or service you consent that the personal information you provide may be transferred and stored in countries outside the EU.

Non-Personal Identification Information

ZMA may collect non-personal identification information about School Users and Family Users whenever they interact with our products and services. Non-personal identification information may include the browser name, the type of computer, and technical information about the means of connecting to our products and services, such as the operating system, the internet service providers used, and other similar information.

Information Received from Internet Service Providers

This website receives information that is automatically generated by a user’s Internet service provider (ISP). This information may include the IP address (a number automatically assigned to a computer by the ISP), the associated URLs, domain types, the browser type use to access our site, the country, state or province, the telephone area code, the location of the ISP’s servers, the pages of our site that the user views during the visit, any search terms entered on this site, and the website address and email address of a user. This information may be collected for system administration purposes, to gather broad demographic information, and to monitor the level of activity on the site. ZMA does not link IP addresses to personal information; however, we reserve the right to link IP addresses and other information supplied by the ISP to personally identifiable information in order to protect the integrity of our system and for security purposes.

Web Browser Cookies

Users’ web browsers place cookies on their hard drives for record-keeping purposes and sometimes to track information about them. Users may choose to set their web browsers to refuse cookies, or to alert them when cookies are being sent. If they do so, note that some parts of the ZMA website may not function properly.

How We Use Collected Information

ZMA may collect and use personal information for the following purposes:

To improve customer service – Information you provide helps us respond to your customer service requests and support needs more efficiently.

To personalize user experience – We may use information in the aggregate to understand how our users as a group use the products and services we provide.

To improve our products and services – We may use feedback you provide to improve our products and services.

 

THIRD-PARTY WEBSITES

Users may find content on the ZMA Teacher Dashboard and the ZMA blog that links to the sites of third parties. We do not control the content or links that appear on these sites and are not responsible for the practices employed by websites linked to or from zorbitsmathadventure.com. In addition, these sites or services, including their content and links, may be constantly changing. These sites and services may have their own privacy policies and customer service policies. Browsing and interaction on any other website, including websites which have a link to zorbitsmathadventure.com, are subject to that website’s own terms and policies.

 

ZMA’s Compliance with COPPA

This section deals with the collection of personal information in the United States from children under the age of 13.

Once teachers register, they then sign up their student(s) by providing each student’s first and last name. ZMA may also require a process to verify teachers’ consent to the registration of their students and to the collection of their students’ first and last names. When teachers and their student(s) use ZMA’s products and services, ZMA will automatically collect information about their patterns of usage, session data, and other information relating to usage, choices, and preferences, including that of their student(s).

For administrative officials of our School Users, to the extent that ZMA collects, uses, or discloses personal information from children under the age of 13, it is done in strict accordance with this Privacy Policy and for the sole purpose of providing services to the School User and its students.

Kinds of Personal Information Collected from Children

ZMA requires School Users to collect the first name and last names of their students. Organizations may require their employees to collect additional student information. This additional information is subject to your organization’s privacy policy.

Information gathered by School Users is used to allow classroom teachers, support teachers, the principal, and possibly the staff of the school district and state Department of Education to access individual students’ performance data with respect to ZMA products and services. These individuals and organizations may choose to share that information with the parents of each individual student.

Disclosure of Personal Information Collected from Children to Third Parties

Students’ personal information and data is stored with Parse LLC. Parse LLC stores but does not use this personal information. Parse LLC has agreed to maintain the confidentiality and security of the information. School Users may share students’ personal information and data with multiple third parties – e.g., other teachers, principals, and district staff – in accordance with their own privacy policies.

Parents’ Right to Withhold Children’s Personal Information

Family Users (e.g., parents) have the option of using ZMA’s products and services without disclosing their children’s personal information.

Parents’ Right to Review, Delete & Refuse Further Collection of Child’s Personal Information

Should a Family User (e.g., parent) choose to disclose personal information about a child to ZMA, the parent can review the child’s personal information, ask to have it deleted, and refuse to allow any further collection or use of the child’s information by contacting ZMA’s Privacy Officer.

Teachers’ Right to Revoke Consent

Because the ZMA learning experience is individualized and customized for each student, we request information from you and your student(s) that is needed in order for you and your student(s) to use ZMA successfully. At any time, you may revoke your consent to allowing your student to use ZMA or refuse to allow ZMA to further use or collect personal information from your student(s). Any anonymous student performance data will be retained, but we will no longer use any identifiable information regarding you or your student(s) that you have provided. Should you choose to revoke your consent, however, you and your student(s) will be unable to use ZMA products and services.

Children’s Internet Protection Act

The Children’s Internet Protection Act (CIPA) is a US federal law enacted by US Congress in December 2000 to address concerns about access to offensive content over the Internet on school and library computers. CIPA imposes certain types of requirements on any school or library that receives funding support for Internet access or internal connections from the “E-rate” program — a program that makes certain technology more affordable for eligible schools and libraries. ZMA products and services do not provide students or children with links to external resources or chat rooms, and do not contain any offensive or inappropriate material.

Family Educational Rights and Privacy Act

The Family Educational Rights and Privacy Act (FERPA) is a federal US law that protects the privacy of student education records. The law applies to all schools that receive funds under an applicable program of the U.S. Department of Education.

FERPA gives parents certain rights with respect to their children’s education records. These rights transfer to the student when he or she reaches the age of 18 or attends a school beyond the high school level. ZMA helps our School Users be compliant with FERPA. Specifically:

·           Any sensitive online information is transmitted over secure channels.
·           All student data are stored in ways that are not publicly accessible.
·           Security audits are regularly performed to ensure data integrity.

ZMA does not share information with any third parties that could be used to personally identify students. If a school requests that student data be sent to a third party, with parental consent ZMA will send the data to the school and never directly to the third party.

ZMA has the discretion to update this privacy policy at any time. When we do, we will post a notification on the main page of zorbitsmath.com and revise the updated date at the bottom of this page. We encourage users to frequently check this page for any changes to stay informed about how we are helping to protect the personal information we collect. You acknowledge and agree that it is your responsibility to review this privacy policy periodically and become aware of modifications.
